1. SERVICES

SpexWeb provides professional services including, but not limited to:

• Website Design
• Website Development
• Website Modernization
• Branding & Graphic Design
• Commercial Printing
• Offset Printing
• Large Format Printing
• Business Cards
• Flyers & Brochures
• Signage
• Digital Marketing
• Social Media Services
• Google Business Profile Optimization
• Consulting Services

SpexWeb reserves the right to modify, update, discontinue, or refuse services at its sole discretion.

2. CUSTOMER APPROVAL & RESPONSIBILITY

The customer is solely responsible for reviewing and approving all artwork, designs, proofs, website content, spelling, grammar, contact information, pricing, images, and specifications before production or publication.

Approval of a proof, design, mockup, or website constitutes acceptance of all content contained therein.

Once approved:

• SpexWeb shall not be responsible for typographical errors.
• SpexWeb shall not be responsible for incorrect information supplied by the customer.
• Additional charges may apply for corrections requested after approval.

3. PRINTING COLOR DISCLAIMER

Customers acknowledge that color variations may occur between:

• Computer monitors
• Mobile devices
• Digital proofs
• Printed materials
• Different print runs
• Different paper stocks

Exact color matching cannot be guaranteed. Minor color variations shall not be considered defects.

SpexWeb will make commercially reasonable efforts to achieve the closest possible color reproduction based on industry standards.

4. FILE SUBMISSION RESPONSIBILITY

Customers are responsible for ensuring all submitted files:

• Are print ready
• Include correct dimensions
• Include proper bleed requirements
• Contain high resolution images
• Have accurate spelling and content

SpexWeb shall not be liable for issues resulting from customer supplied files.

5. WEBSITE CONTENT RESPONSIBILITY

Customers retain full responsibility for:

• Text content
• Images
• Logos
• Copyright permissions
• Trademarks
• Licensing rights

SpexWeb assumes all customer provided content is legally owned or properly licensed.

Customers agree to indemnify and hold SpexWeb harmless from any claims arising from unauthorized use of content.

6. WEBSITE PERFORMANCE

While SpexWeb follows industry best practices, SpexWeb does not guarantee:

• Search engine rankings
• Google placement
• Traffic increases
• Sales increases
• Lead generation results

Online performance depends on numerous factors beyond SpexWeb's control.

7. PAYMENT TERMS

All projects require payment according to agreed project terms.

Projects may require:

• A deposit is required before commencement of project
• Progress payments
• Final payment prior to delivery

Late payments may result in:

• Project delays
• Suspension of services
• Website suspension
• Collection efforts

8. CANCELLATION POLICY

Projects canceled after commencement may be subject to fees based upon work completed.

Deposits are generally non-refundable once work has begun.

Custom design, development, and print production services are non-refundable after approval and production.

9. INTELLECTUAL PROPERTY

Upon full payment, customers retain ownership of their approved content.

SpexWeb retains ownership of proprietary tools, processes, templates, frameworks, coding methods, and internal systems unless otherwise agreed in writing.

SpexWeb reserves the right to display completed work within its portfolio and marketing materials.

10. LIMITATION OF LIABILITY

SpexWeb's total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim.

Under no circumstances shall SpexWeb be liable for:

• Lost profits
• Lost business opportunities
• Indirect damages
• Consequential damages
• Data loss
• Third-party service interruptions

11. FORCE MAJEURE

SpexWeb shall not be liable for delays or failures caused by circumstances beyond reasonable control, including:

• Natural disasters
• Internet outages
• Utility failures
• Supply chain disruptions
• Acts of government
• Third-party vendor failures

12. ACCEPTANCE OF TERMS

By using SpexWeb services, customers acknowledge they have read, understood, and agreed to these Terms & Conditions.
